A Study on the Comparing and Integrated Law System of the Healthcare System between South and North Korea in preparation for Unification

Abstract
This thesis tried to find a desirable direction for the unified health and medical system in line with the spirit of the new era based on mutual respect, out of the era of inter-Korean confrontation and conflict. Furthermore, it was attempted to derive effective measures for maintaining a sustainable legal system without being influenced by political conditions in South and North Korea, and at the same time suggesting major contents in each area of health care. In order to realize the purpose of this study, I tried to analyze the development process of the health and medical system in North and South Korea and the main contents of the health and medical system in North Korea, and at the same time, to conduct a comparative study on the unified health and medical system in Germany. The main contents of this study can be divided into four areas. First, comparative analysis of the process of formation and transition of health care legislation in North and South Korea after liberation, analysis of the health and medical conditions in North Korea and legislation by health care sector, and the development process and main contents of health care legislation in Germany, which overcame the division before Korea and achieved unification And lastly, it was intended to examine the measures to secure the effectiveness of the unification health care law, which will be formed in accordance with the establishment of new inter-Korean relations, and its main contents. First, in the process of forming and changing health care legislation in South and North Korea, we compare the development of health care legislation in South Korea and North Korea after liberation, and attempt to reclassify the stages of development of health and medical legislation in South and North Korea by period according to the characteristics of the common legal system. The commonalities and differences in the legal system were analyzed. Second, in the analysis of North Korea's health and medical conditions and legislation by health care sector, according to the contents and characteristics, laws related to the health care system, laws related to health management of specific population groups and specific diseases, and laws related to health care financing are analyzed. Third, in the analysis of the development process and main contents of the health care legislation in Germany, the preparations and procedures in the legal system integration process in the German unification process were reviewed, and the legal nature and major contents of the health agreement between East and West Germany were analyzed in detail. In addition, in the plan for securing the effectiveness of the unification health care law, which will be formed in accordance with the establishment of new inter-Korean relations, and its main contents, the procedure that can have legal effectiveness in South and North Korea when a unified health care law or health agreement is concluded based on new inter-Korean relations and to suggest a plan.
